How To Get A Digitized Taxpayer Identification Number (TIN) ID?

In Philippines, the government and other private sectors are getting strict in their implementations. Sometimes, there are transactions we made between their offices that we need to present our valid identification card. When we also open or create a bank account, valid ID is also a requirement. When we go to remittance centers to receive money or any consignment from our love ones in other areas, they asked again for a valid identification card.

But what if the person is not employed and doesn’t even have driver’s license, passport or any other type of valid IDs, of course, it is a big problem to them.

The good thing is that the government started to issue the Tax Payer Identification Number (TIN) Card to be used in any government transactions in the country including private transactions. For those who have already Tin no. but has no Tin No. Card could avail of this. Just take note that having more than one Tin No. is not allowed because you can be charged criminally.

This initiative is under the Executive Order 98 where a person could apply in their Revenue District Office which has jurisdiction over their location. The said identification card has no expiration date and free for the public.

Requirements:

The following are needed when you apply for a digitized TIN ID.
  • Copy of your NSO Birth Certificate
  • Valid ID (Driver’s License, SSS, Passport, COMELEC ID)

Steps on How to Apply:

  • Go to nearest BIR office with the jurisdiction of the place where you work/reside.
  • Ask for a TIN Application form. You will need BIR Form 1904 for EO 98.
  • Fill out the form and submit to the counter along with your proof of identification.
  • Receive your Tax Identification Number.
  • Request for a BIR ID which you are entitled to under E0 98.
The processing of TIN No. Card could take only less than hour, but for busy BIR offices, you may have to come back in another day to claim your ID.

How To Renew Your Philippine Passport While Abroad?

Can I renew my Philippine Passport while I am in abroad? How long does it take to renew it? What are then the requirements? These are just some of the queries that a traveler may know about the actions to be taken. If you are one of them, focus your eyes on reading.

According to the new law signed by our dear president, the Philippine passport will now be valid for 10 years from its previous 5 years of validity. The Republic Act # 10928 that amends the Sec. 10 of RA no. 8239 or the Philippine Passport Act of 1966, states that those regular passports issued under this act shall be valid for a span of 10 years. However,  those passports which were also issued under the old law will only be valid for 5 years.

In addition, those carriers of passports below 18 years of age will be only issued valid for only 5 years and passport validity of less than 10 years may be issued whenever in the National economic interest or political stability of the country such restriction is necessary.

How about now those Filipino travelers who are in abroad especially OFWs who are about to expire their passports? Do they need to return in our country just to renew their passports? The answer is NO.

Once a Philippine Passport will expire and the holder is outside the country, they have a 1 year renewal period to process their passports. The best part then is that, even in their working place (outside the Philippines), they can now renew it.  What they just to submit are the documents to prove their identification and legality. It includes the following:

  •  the latest passport you had
  • accomplished passport application form from the country you are in, be sure that it is printed in blue or black ink only.
  • any proof that the applicant can provide that would say he/she has not applied for foreign citizenship, e. g.  resident alien card (green card)
  • self-addressed return envelope, with appropriate stamps for express or priority mail with tracking nos.  Via US postal service; or with prepaid mailing envelope from private courier of choice if passports is to be mailed back.
  • passport  fee of $60.00 (non-refundable), payable in cash,  or money order,  bank draft,  certified check or cashier's check made payable to "Embassy of the Philippines" (or "Philippines Consulate General; " if application is made at one of the Philippine Consulates General in the U. S). Personal checks and credit cards are not accepted."
  • at least one (1) photocopy of each of the data page/s of the passport; (pages 1-3 for the brown passport or page 1 for the green passport)
  • photocopy of any valid identification card where the middle name is fully spelled out: (State ID,  driver's license,  birth certificate, marriage certificate, or baptismal certificate (if applicant's passport is the brown one)

Note that these following documents are required in the U.S. A renewal of Philippine Passports only.  Firstly, you may ask the country your residing by this time if you need to prepare them.  There might be documents which were added or lessened so be sure to check.

The process of renewing the said passport is by visiting the Phil.  Embassy in your host country and submit the documents to the consulate general. He will be the one in charge in notifying the Department of Foreign Affairs in Manila about it and it will take approximately 8 weeks for your passport to be process completely.

If your option is to personally claim your passport, you can't include the 4th requirements  from the list above.  However, if you're not around in the deadline time to claim your passport, you can assign somebody to get it in the Philippine Embassy. He/she must only present the authorisation letter signed by you,  your old passport, your valid ID photo,  and valid ID of the claimee as well.

Single Parent: How To File a Child Support in the Philippines?

Filipino women are known for their being modest because of the practices and cultures of our country that mold and defined them. As years passed by, modernization has evolved that changed lives of people. Those cultures and tradition then that we inherited to our pedigrees were forgotten. Issues about pre-marital sex that leads to the early pregnancy of women are very rampant in the society. The worst, their partners neglected them and let them suffer in the end.

On his generation, getting involved in separation that ended in being a single parent especially for women is no longer new or surprising to everybody. Single mothers who are the common victims are the ones that experience the hardship to take good care of their children in order to give them a brighter future. But being a mother as well as a father is not an easy role. For this days, the status of being jobless has nearly similarities with the status of having a job because of our poor economy. However, for you to maintain an adequate financial support to your children, you can make a move to demand child’s support from your ex-spouse or ex-partner.

As stated in the Family Code of the Philippines, “When one of the spouses neglects his/her duties to the conjugal union or commit acts which tend to danger, dishonor or injury to the other or to the family, the aggrieved party may apply to the court for relief.” The act also included the economic abuse in which you may file for your child support and whoever breaks this law will be penalized accordingly.

All you need to do before taking any steps is to prepare for everything. Of course, once you file in court regarding your concern, you need to prepare fund for court fees. Not all who ask for support can pay the fees, however, if you really don’t have the money, the government will provide one of your counsel that belongs to the Public Attorney’s Office, Department of Justice or the Department of Social Welfare and Development, depending on the case. The protection order is issued by the court and in some cases, this is the privilege given to the aggrieved party to protect them.

The Regional Trial Court who has also the function to be the family court will hear and decide the case. The mother’s child will be the one who will file for his child’s support and as stated in the law, 7 years of age should be under the custody of their mother.

Once the court will grant the demand for the support of the child from his father, it is then the responsibility of the latter to abide by rules of law. Support is applied for legitimate and even illegitimate children by fathers depending on their capacity to provide. According to the law, “support comprises everything indispensable for sustenance, dwelling, clothing, medical attendance, education, and transportation, in keeping with the financial capacity of the family.” So as a parent, you should not be obliged or forced to support your children but you should be full-time to give them the support, love, and care they need.

Even separation is the gap between the mother and father, this would not be the hindrance for each of the parents to provide the attention and support needed by their children.

How Much an Annulment in the Philippines?

The case of annulment in the Philippines is very rare. The main reason why is because of its very expensive cost. Most of the Filipinos choose to be practical and not everyone could afford to apply for it. Maybe even a rich man would double his mind before applying for annulment unless he has really the strong desire to void the marriage.

From the beginning, what is first an annulment? Are they similarities with divorce? In the Philippines, divorce is never been applicable because it is not in the book of law but an annulment could be. Annulment is a legal process where the courts declare a marriage null and void. Unlike divorce, it is usually retroactive, meaning that an annulled marriage is considered to invalid from the very beginning. To simplify it, a marriage has never happened. There were no husband and wife unite together, ever.

A marriage could be declared void according to Art. 45 of the Family Code of the Philippines thru annulment on the following grounds. The lack of parental consent if either party is at least 18 but below 21 years old, the involvement of fraud, the consent for marriage by the parent but obtained by force, intimidation, or undue influence, the impotency or physical incapability of consuming the marriage, for having serious sexually transmitted disease and the most common ground used as a defense is being psychologically incapacitated by your partner. All of these grounds, when proven by the court, could annul the sanctity of a marriage. It can also lead a family to be miserable especially for children where at the first place, the spouse use only the process of annulment for his own interest.

According to Att. Raymund Fortun, he revealed in an episode of “Bawal Ang Pasawa Kay Mareng Winnie” that annulment in the Philippines could cost around P450,000. Fortun said that he gave one of the lowest expected amounts because there are bigger firms that may charge by the hour and the final bill could easily double the figure he gave.

Aside from the money, the length period of time for processing should also be considered. Att. Fortun said that the duration of years for his longest case was 3 years. This is due to several factors. A typical case can last up to 1 year and 2 months.

Atty. Fortun and Pro-Divorce PH Chair Asliyah Limbona bring out a message during the show to mandate the office of the Solicitor General to protect the sanctity of marriage as another factor complicating the process. Abolishing this mandate could change the constitution, Att. Fortun said.
